General Terms and Conditions Capture That Interior

Article 1 Definitions

1. Capture That Interior, located in Middenbeemster, Chamber of Commerce number 61937983, is referred to in these general terms and conditions as Capture That Interior.
2. The person who participates in a course is referred to as a participant.

3. The person who purchases a subscription is referred to as a member.
4. The agreement means the assignment agreement on the basis of which Capture That Interior makes content available to the participant and/or member in return for payment of a fee and costs and to which the general terms and conditions have been declared applicable.

Article 2 Applicability of general terms and conditions

1. These conditions apply to all offers, invoices, work, agreements and delivery of services and products by or on behalf of Capture That Interior to which it has declared these conditions applicable, insofar as these conditions have not been expressly deviated from in writing.

2. The most recently sent version of these general terms and conditions always applies.
3. Capture That Interior has the right to unilaterally change these conditions if it deems this necessary. The new conditions will be communicated to the participant and/or member before they come into effect.
4. These general terms and conditions also apply to third parties engaged by Capture That Interior in the context of the assignment.
5. If one or more provisions in these general terms and conditions are wholly or partially null and void or annulled at any time, the remainder of these general terms and conditions will remain fully applicable.
6. If Capture That Interior allows deviation from these general terms and conditions, this does not affect its right to demand immediate and strict compliance with the other provisions.

 

Article 3 Complaints

 

1. Participant and/or member is obliged to submit complaints about invoices and/or the services provided to Capture That Interior in writing and with reasons as soon as possible, but no later than 7 calendar days after the complaint arose, by sending an e-mail to send to hello@studio-muk.com.

2. If a defect is reported later, the participant and/or member no longer has an absolute right to repair, replacement or compensation.

3. Capture That Interior strives to send notification of receipt of the complaint within one working day and to handle the substantive complaint within one week.

4. Submitting a complaint does not suspend the payment obligation.

Article 4 Dispute resolution

1. Dutch law applies to these general terms and conditions.
2. Parties will only appeal to the court after they have made every effort to settle a dispute by mutual agreement.
3. All disputes will be settled by the competent court in the district in which Capture That Interior is located.
4. Notwithstanding the statutory limitation periods, the limitation period for all claims and defenses against Capture That Interior and third parties involved is 12 months.

Participation in a course and/or subscription

Article 5 Offer

1. Capture That Interior cannot be held to its offer if the participant and/or member could reasonably understand that the offer, or part thereof, contains an obvious mistake or typo.
2. If the offer is accepted and the course or subscription is purchased online, a payment obligation immediately arises for the participant and/or member.

Article 6 Rates and payments

1. The prices stated on the website are exclusive of VAT, unless explicitly stated otherwise. 2. The purchase of a course or a subscription creates an obligation to pay, even if the entire course is not completed or the content made available is used.

3. Participant and/or member will only have access to the content after full payment of the agreed amount.
4. The rates agreed upon when entering into the agreement are based on the price level applied at that time. Capture That Interior has the right to adjust the fees when re-teaching a course or starting a new month in the subscription. It also has the right to adjust the price in the run-up to a course for promotional purposes.
5. Contrary to what is stated in the previous paragraph of this article, the price for current members will not be increased as long as they do not terminate the subscription.
6. If the member fails to pay an invoice on time, a direct debit cannot be collected, a direct debit is withdrawn without good reason or a payment is reversed when a subscription has not been canceled on time or correctly, the member is After sending a one-off reminder or notice of default, you are legally in default and statutory interest is due. The interest on the amount due will be calculated from the moment the member is in default until the moment the full amount is paid.
7. If the member is in default or defaults in the fulfillment of his obligations, all reasonable costs incurred to obtain payment out of court will be borne by the member.
8. If payment in installments is agreed, Capture That Interior is entitled to suspend the agreement until the next payment has been made.
9. If the member fails to make timely payment, access to the content will be denied. If the subscription is not canceled on time or correctly (see Article 14), the payment obligation will continue to exist in such a case.

 

Article 7 Execution of the agreement

 

1. It is not possible to purchase a course or subscription if you have not yet reached the age of 18.

2. Capture That Interior will execute the agreement to the best of its knowledge and ability. However, it is not responsible for failure to achieve the result that the participant and/or member intended with the purchase.

3. Because Capture That Interior's services are provided online, it cannot guarantee that its services are available at every location at all times.

4. A course or subscription can only be followed with one Instagram account, either a business or personal account.

5. The Capture That Interior reserves the right at all times to refuse a participant and/or member. 6. The offer and activities that are part of a course and/or subscription may change from time to time. Capture That Interior is entitled to expand, limit or modify the content.

 

Article 8 Provision of information

 

1. The participant and/or member shall make all information relevant to the execution of the assignment available to Capture That Interior in a timely manner.
2. The participant and/or member guarantees the accuracy, completeness and reliability of the data made available, even if it comes from third parties.

3. The participant and/or member indemnifies Capture That Interior against any damage resulting from failure to comply with the provisions of this article.
4. If the participant and/or member does not provide the required information or does not make it available in a timely manner and the execution of the assignment is delayed as a result, the resulting consequences will be borne by the participant and/or member.

 

Article 9 Liability for damage

 

1. Capture That Interior is not liable for damage resulting from this agreement, unless the direct damage was caused intentionally or with gross negligence.
2. Participant and/or member remains responsible at all times for applying or performing knowledge or actions gained while following the content.

3. In the event that Capture That Interior owes compensation to the participant and/or member for causing direct damage intentionally or with gross negligence, the damage will not exceed the amount charged by Capture That Interior in that three months prior to the damage occurring.

4. The participant and/or member indemnifies Capture That Interior against all claims from third parties related to the services and goods provided by it.

 

Article 10 Intellectual property

 

1. Unless otherwise agreed in writing, Capture That Interior retains all intellectual absolute rights, including copyright, to all data, information provided and content made available.

2. Capture That Interior grants the participant and/or member a limited, personal, non-exclusive, non-sublicensable and revocable right to use a course or subscription for personal purposes. The content is intended to inspire, not to copy.
3. Shared content may not be copied, shown to third parties, made available, resold or used in any other way without written permission from Capture That Interior. Participant and/or member may share parts of the content on social media to a limited extent if this material is provided with the name of Capture That Interior.

4. The participant and/or member is also not permitted to use the written documentation associated with the course or subscription, including workbooks and appendices, for purposes other than personal use.
5. If this article is violated, copyright will be infringed. In such a case, Capture That Interior is entitled to invoice the participant and/or member for the damage suffered and, if justified, to exclude them from participation.
6. The information and services provided during the term of the agreement remain the property of Capture That Interior. She will indicate in a timely manner until when the content is available. It is the participant's and/or member's own responsibility to view the material in a timely manner and to save it where the option is given.
7. Content that is offered for life means as long as Capture That Interior exists, or the platform on which the content is offered. In such a case, Capture That Interior cannot be held responsible for not fully completing the content.
8. If the subscription is terminated, this will be communicated to the members no later than three months prior to the end date and a direct debit will be stopped as of the end date.

 

Article 11 Communication

 

1.Both parties are obliged to maintain confidentiality of all confidential information they have obtained in the context of their agreement. Participant and/or member is referred to the privacy statement for more information.

2. While participating in a course or subscription, participants and members can communicate with each other, for example by posting comments in the community under posts. The participant and/or member declares not to send spam or otherwise unwanted communications. Acting in violation of these conditions may result in immediate denial of access and use of Capture That Interior's services.

3. Capture That Interior is free to remove communications or other parts of the shared information at any time without further notice, if the content of this communication and information justifies its removal.
4. Capture That Interior reserves the right to exclude participants and/or members who, through their behavior, hinder or complicate the course of a course or subscription, from further participation and, if necessary, from future participation. Exclusion does not affect the obligation to pay the costs for the relevant content.

 

Class

 

Article 12 Content and duration of the course

 

1. The course duration varies per course and can be taken at your own discretion and at your own pace, as long as the content is made available.

2. The participant retains access to the content of the course for at least 1 calendar month, during which it can be viewed without restriction, unless otherwise agreed. The participant is responsible for completing the content in a timely manner.

3. If necessary, the content of the course will be regularly updated.

 

Article 13 Change and cancellation

 

1. Participant will receive access to the course after purchase. The course is therefore excluded from the right of withdrawal, which means that the participant does not have the option to cancel the purchase and receive a refund of the purchase price. The participant does have the right to terminate the agreement to purchase a course within 14 calendar days after purchase if the participant can demonstrate that the content does not meet the expectations that the participant could reasonably have. Assessment of this is the sole responsibility of Capture That Interior.

2. Participation in a course is personal, so only one login account can be linked to a purchase. If the purchaser wishes to give the course as a gift, this must be indicated by e-mail to hello@studio-muk.com immediately after purchase.

In the event of unforeseen circumstances, Capture That Interior has the option to interrupt, move or cancel a course. Unforeseen circumstances include illness and circumstances that arise with regard to materials that are necessary for the proper execution of the agreement. Capture That Interior will notify the participant of any changes as referred to in this paragraph as soon as possible and a suitable solution will be sought.

 

Subscription

 

Article 14 Change and cancellation

 

1. Member receives access to the subscription the month after purchase. The subscription is a continuous subscription with a minimum term of one calendar month, until timely cancellation by the member. Cancellation is only final after confirmation by Capture That Interior.

2. Valid cancellation of the subscription must take place as follows: to terminate a monthly subscription, the member must send an email to hello@studio-muk.com no later than the 24th of the month in question with the subject “cancellation of subscription” . In the case of a quarterly subscription, this must be done no later than the 24th of the last month of the quarterly subscription. If cancellation is not made on time or incorrectly, the subscription and therefore the direct debit will continue for the same period as the purchase and cancellation is only possible again on the 24th of a following month or quarter.

3. Cancellation cannot take place via telephone or direct message. Only cancellations submitted by email will be processed.
4. Any change other than cancellation must also be notified to Capture That Interior by e-mail.
5. Participation in the subscription is personal, so only one login account can be linked to a purchase. If the purchaser wishes to give the subscription as a gift, this must be indicated by e-mail to hello@studio-muk.com immediately after purchase.
6. In the event of unforeseen circumstances, Capture That Interior has the option to interrupt, move or cancel a subscription or part of the subscription. Unforeseen circumstances include illness and circumstances that arise with regard to materials that are necessary for the proper execution of the agreement. Capture That Interior will notify the member of any changes as referred to in this paragraph as soon as possible and the content will be made available at a later time.
7. Capture That Interior reserves the right to change or stop part or all of the functionality of the subscription for a certain period or forever. This will always be communicated to the member in a timely manner.
